Who wrote the Constitution of India?

You don’t think that the 395 articles in 22 parts, 14 schedules and 94 amendments and a total of 117,369 words were written by just a handful of intelligent men and women, do you? It was worked upon by 205 elected and nominated Indians from across the country. As India completes 60 years of being governed in letter and spirit by the Constitution, here is a quick look at the forgotten luminaries who have got lost in the annals of history despite their contribution in its formation.

भारताचे संविधान कुणी लिहिले ???

या प्रश्नाच उत्तर जवळपास सर्वमान्यच  आहे ते म्हणजे... भारताचे संविधान आंबेडकरांनी लिहिले.

परंतु सहज माझ्या मनात आल फ़क्त "एका व्यक्तिसाठी" इतक मोठ, तर्कसंगत, सुटसुटिट, कायदेशीर लीखान करण शक्य आहे का?... ते पण केवळ 3 वर्षाच्या कालावधीत ..... म्हणजेच संवैधानिक सभेच्या स्थापने पासून (9 डिसेम्बर 1946) ते संविधान अंगीकृत करेपर्यंत (26 नोहेम्बर 1949).

मला हे पूर्णपणे पटल नाही की केवळ अम्बेडकरांणी संविधान लिहिल. त्यामुळे इतिहास शोधन्यास सुरुवात केली व खालील माहिती माझ्या हाती लागली ती तुमच्यासोबत share करतोय...

1947 ची फाळणी योग्य रितीन व अहिंसेन व्हावी यासाठी ब्रिटिशांनी 'द इंडिपेंडेंस एक्ट 1947' भारत व पाकिस्तानला दिली, ज्यानुसार दोन्ही देशांना आप-आपली संविधान बनवन्यासाठी स्वतंत्र संवैधानिक सभा (constituent assembly) बनवण्याचे अधिकार दिले.
यानुसार भारताने आपली संवैधानिक सभा 9 डिसेम्बर 1946 ला बनवून पहिली बैठक घेतली.

या संवैधानिक सभेत अस ठरवण्यात आल की संविधान "लिहन्याच् काम" एका व्यक्तीच्या आवाक्या बाहेरच आहे, त्यामुळे खालील प्रमाणे 5 वेग-वेगळ्या समित्या स्थापित केल्या...

1. संघ शक्ति समिति- चेयरमैन- जवाहरलाल नेहरू... मेंबर संख्या-9

2. मूळ अधिकार व अल्पसंख्यक समिति- चेयरमैन- वल्लभभाई पटेल... मेंबर संख्या-54

3. कार्य संचालन समिति- चेयरमैन- डॉ के. एम. मुंशी... मेंबर संख्या-3

4. प्रांतीय संविधान समिति- चेयरमैन- वल्लभभाई पटेल ... मेंबर संख्या-25

5. संघ संविधान समिति- चेयरमैन- जवाहरलाल नेहरू... मेंबर संख्या-15

".... म्हणजे पाच समित्या मिळून 106 मेम्बर्सनि अथक मेहनत करुन आपल्या संविधानातील प्रत्तेक कलम लिहिली..."

पुन्हा माझ्या मनात प्रश्न, की फ़क्त आम्बेडकरनाच 'संविधानाचे शिल्पकार' का म्हणावे...??
पुढे अभ्यास केला तर कळाल की...

या पाच समित्यांनी संविधान लिहून पूर्ण केल्यावर 29 ऑगस्ट 1947 ला 7 सदस्सीय "ड्राफ्टिंग समिति" बनवली, या समितिच् कार्य होत... लिहिलेल्या संविधानाचे अभ्यास करने व गरज असल्यास नवीन कलमा 'सूचवणे'. व शेवटी ड्राफ्ट तैयार करुन प्रस्तुत करने.

या ड्राफ्टिंग समितीचे चेयरमैन सर अल्लादि कृष्णास्वामी होते, ड्राफ्ट तैयार केला होता तो सर बी. एन. राव यांनी.... आणि हा सम्पूर्ण तैयार झालेला ड्राफ्ट सभेसमोर (अर्थात देशसमोर) "प्रस्तुत" करण्याच् काम डॉ आम्बेडकरांना सोपवण्यात आले, कारण 15 ऑगस्ट 1947 ते 26 जानेवारी 1950 पर्यंत ते कायदेमंत्री होते, व कुठलाही कायद्यासम्बन्धिचा ड्राफ्ट प्रस्तुत करण्याच् काम त्यांचच होत.....

मी आंबेडकर विरोधी नाही, पण संविधानाच लिखाण कस झाल व ते कुणी-कुणी केल याचा अभ्यास केल्यानंतर एक खंत मनात राहिली की...

113 विद्वान लोकांद्वारे (अर्थात् आंबेडकर धरून) लिखित संविधानाच श्रेय फ़क्त एकाच व्यक्तीला का दिल जातं ??
यात कुणाचा राजनैतिक फायदा तर नाही ना ??
की आपण इतक्या क्षीण बुद्धिचे आहोत की, आपल्याला या गोष्टिचा फरकच पडत नाही की संविधान कुणी लिहिलय ??

"माझ्या मते हे सर्व 113 विद्वान संविधानाचे शिल्पकार आहेत"

मत किंवा तथ्य मांडण्यात त्रुटी झाली असल्यास क्षमा असावी.

Few of the names are:

Benegal Narsing Rau: The most eminent jurist of his time, Rau not only played a key role in drafting the Constitution of India but also that of Burma. He was appointed an advisor to the Constituent Assembly and though was not part of the Committee itself, he was next to Amedkar in his role. Rau, who was knighted in 1938 for revising the entire Indian statutory code, was responsible for the democratic structure of the Constitution and prepared the final draft. He went on to represent India at the UN Security Council and was a judge at the International Court of Justice in The Hague. He was a combination of hard work, humility, search for perfection and erudition.

Saiyad Mohammed Saadulla: Representing Assam, Saadulla was a member of the Muslim League. He was an eminent member of the steering and drafting committees which worked under Rajendra Prasad and Ambedkar respectively. He became the premiere of Assam twice and was knighted by the British in 1928.

Dr Sachchidananda Sinha: An eminent Congress man, Sinha was chosen to preside over the first session of the Constituent Assembly and his name was suggested by Acharya Kruplani. In his inaugural address, he asked the members to deeply study prominent Constitutions of the world, especially the American one- a source from where eventually the Indian Constitution borrowed a lot, including the principle of separation of powers. He inspired those present by invoking Iqbal and concluding with a quote from the Bible: Where there is no vision, the people perish.

M A Ayyangar: He represented Madras and was a prominent member of the steering committee. He was the first Deputy Speaker of the Lok Sabha and was handpicked by Nehru to fill in the void left by the demise of the first Speaker GV Mavalankar. He was a member of the first elected council in India and was known for his phenomenal memory, Sanskrit knowledge and a keen interest in culture. He also became the Governor of Bihar in 1962.

N Gopalswami Ayyangar: An able administrator, Ayyangar was a member of the rules, business, drafting and several other committees. He was a lawyer-politician who represented Madras in the Constituent Assembly. Ayyangar played a key role in the exposition of Article 370 and was responsible for closing the differences between Sardar Patel and Sheikh Abdullah.

आपका भाषण सुना जो आपने जेल से वापस आ कर दिया, सुना कि आपको ग़रीबी, भुखमरी, जातिवाद, साम्राज्यवाद और पूँजीवाद से आज़ादी चाहिये। मेरे विचार मे, इन सबसे आजादी पाने के लिए मन लगाकर पढाई करें, खूब मेहनत करें, कैरियर बनायें और आगे बढ़ें तो अपने आप मिल जायेगी आजादी और अापके साथी जो नारे लगा रहे हैं उनको भी ये समझायें। आपका भाषण तो अच्छा था लेकिन मैं आपकी बातों में लाजिक ढूँढ़ने की कोशिश कर रही थी, इसके लिये मेरे दो चार सवाल है ज़वाब देने की मेहरबानी करें

1- आपका भाषण तो पूरा राजनैतिक था, तो ये पढ़ाई का ढोंग क्यों?? बाहर आईये और राजनीति में करियर चमकाईये और अपनी जगह किसी उपयुक्त छात्र को दीजिये जो पढ़ाई के नाम पर राजनीति न करे। पढ़ाई के नाम पर ये मुफ़्तख़ोरी बंद करिये, आपके राजनैतिक करियर पर टैक्स पेयर जनता का पैसा बर्बाद क्यों हो??

2- ग़रीबी, भुखमरी, जातिवाद, साम्राज्यवाद और पूँजीवाद ... लेकिन ये नही बताया ये समस्या कब से है ? और इसके असली जिम्मेदार कौन है ?? ज़रा बतायेंगे ये सारी समस्यायें कब से हैं ?? या ये सिर्फ पिछले 18 महीने मे खड़ी हुई हैं ?? जो पार्टी 60 सालों से राज कर रही थी उसकी जवाबदारी कितनी मानते है या उनके शासन में रामराज्य था ??आप प्रधानमंत्री की सूट पकड़ कर उनसे प्रश्न पूछना चाहते हैं तो सोनिया गांधी की साड़ी पकड़ कर उनसे प्रश्न क्यों नही पूछते??

3- आपके बताया नहीं कि ग़रीबी, भुखमरी, जातिवाद, साम्राज्यवाद और पूँजीवाद को कैसे हटायेंगे और इसका ब्लूप्रिंट क्या है या सिर्फ़ नारों से हट जायेगी ?? आज सारी दुनिया मे वामपंथ फ़ेल हो चुका है तो ये भारत में किस तरह से सफल होगा ??

4- आपकी पार्टी की सरकार पश्चिम बंगाल मे 35 साल तक थी, आप बतायेंगे कितनी ग़रीबी, भुखमरी या जातिवाद दूर हो गया?? आँकड़े तो इसका उल्टा ही बताते हैं तो हम क्यो विश्वास करें आपका??

5- अगर भारत के संिवधान या लोकतांत्रिक मूल्यों में विश्वास करते हैं तो जनता के बीच जाकर, चुनाव लड़कर ईमानदारी से सिस्टम मे सुधार करते और ग़रीबी भुखमरी के खिलाफ लड़ते न कि जनता द्वारा चुनी हुई सरकार के खिलाफ ज़हर उगलते

6. आपको पुलिसवाला अपने जैसा ही इंसान लगा अच्छी बात है पर बतायेंगे जिन पुलिसवालों को दंतेवाड़ा में आपके साथियों(DSU) ने मारा वो अपने जैसे लगते थे या नही ?? जिनकी मौत पर JNU में जश्न मनाया जाता है वो भी ग़रीब परिवार के ही थे जिन्हें लाल सलाम वालों ने मारा है

7- आपको फ़ौजी भी अपने जैसे लगते हैं ना, तो आपके साथ कंधे से कंधा मिला कर जो नारे देते हैं 'भारत तेरे टुकड़े होंगे' कभी सोचा है उनके उपर क्या गुज़रती होगी ?? उनका मोराल कितना डाउन होता होगा ?? कभी सोचा है एक भारतीय की आत्मा तड़पती है जब JNU के ये नारे सुनते हैं "भारत की बर्बादी तक जंग रहेगी" आपको भी यही लगता तो आप कहीं विरोध दर्ज करते ना

8- आप कहते है कि इस देश के क़ानून पर आपको भरोसा है तो कैसे आपके साथी तो आपके सामने ही नारा देते हैं ?? "अफ़ज़ल हम शर्मिंदा हैं, तेरे क़ातिल ज़िंदा हैंंंं', "कितने अफ़ज़ल मारोगे, घर घर से अफ़ज़ल निकलेगा",
पुलिस वालों से आपको सहानुभूति है ना, कितने पुलिसवाले संसद में हुए हमले में कितने मरे मालूम है या दिल में अफ़ज़ल से आधी भी सहानुभूति है ?? ये भारत की सर्वोच्च न्यायालय का ही तो फ़ैसला था फिर ये आपका ढोंग नहीं है तो और क्या है ??

9- रोहित वेमुला जिसका SFI से मोहभंग हो चुका था उसका येचुरी के बारे में लिखा ख़त/विचार क्यो नहीं बताया?? क्योंकि वो आपकी विचारधारा को सपोर्ट नहीं करता ??मरने वाला इंसान कभी झूठ नहीं बोलता और dying declaration तो कोर्ट भी मानता है, जब रोहित ने आख़िरी ख़त में किसी को भी ज़िम्मेदार नहीं बताया पर आप किसी न किसी तरह से इसका भी राजनैतिक फ़ायदा उठाना चाहते है तभी तो ये मुद्दा बार बार उठाते हैं

आपकी असली समस्या है एबीवीपी, आरएसएस, बीजेपी और मोदी जिनसे आज़ादी चाहिये, आपको लोकतांत्रिक ढंग से चुनी सरकार नहीं चाहिये क्योंकि आपको पंसद नही, उसके जाने के बाद सब आज़ादी मिल जायेगी। भाषण की जगह बस एकबार अपना ही जजमेंट ही पढ़ कर सुना देते छात्रों के सामने, ख़ुद पर शर्म आ जायेगी और सारी ग़लतफ़हमी दूर हो जायेगी

While the JNU fracas and fiasco is being played out in the media for almost two weeks, this is what also happened

a) India struck a unique oil deal with UAE, which will land it 4 Million barrels of oil almost free after 5 years.

b) Indian Railways auctioned scrap for almost Rs.3000 crores through an online auction that is transparent and therefore scam free.

c) The #MakeinIndia event in Maharashtra saw commitments of Rs.15.2 lakh crores. Even if we assume a 10% conversion of those commitments, there are possible investments of Rs.1.52 lakh crores.

d) First batch of 800 cars have been shipped from Chennai port to Kandla. Seaway movement  of cargo within the country was not permitted under law. The present government changed that law. This would result in transportation costs dropping to almost 1/3rd from Rs. 1.50 per kg per km to Rs.0.50 per kg per km.

Good work is happening in the country. The government may not be working at a pace you desire, but it is working - away from the noise and hubris of the news channels !
